TERMS OF USE
These Terms of Use (together with the documents referred to in it) tell you the terms of use on which you may make use of our virtual office address service at 5 Totnes Road, Newton Abbot, Devon, TQ12 1LY for you business.
Please read these Terms of Use carefully before you start to use our service, as they will apply to your use of our service.
By using our service, you confirm that you accept these Terms of Use and that you agree to comply with them. We may revise these at any time by amending this page.
If you do not agree to these Terms of Use, you must not use our service.
Our Service
Our service allows business customers to make use of our company address as a virtual office address for a monthly or annual service charge as agreed with the client for the purposes of its use on letterheads, websites, advertising materials etc, and we offer extra services such as mail forwarding and scanning mail to email for an extra additional charge.
You agree;
All mail sent to our virtual office address service must be clearly marked with the business name you registered for the service with when creating the account, which will need to included in the postal address on the item, or it will be discarded.
We agree;
To notify you upon receipt of any mail for the business name you registered with us when creating you account to our virtual office address service via email to your nominated email address to notify you and to request if you would like it forwarded or scanned and sent via email at extra cost to you.
Upon payment our virtual office address charge that your new account to use our service will be setup and available for use within 24 hours.
We offer a mail forwarding service for extra cost which makes use of UK 1st class postage to forward email to you, with all mail sent under this service upon request within working 3 days as a minimum, and will be subject to the time it takes Royal Mail to deliver it to you following this.
When forwarding mail to you we will use the address you have given us when creating your account with us unless otherwise notified of a change of address.
Our scanned to email service is available upon request and we agree to scan and forward mail to your nominated email address at an extra cost and within 3 working days upon request of this.
All unclaimed and not forwarded mail will only be stored for the period of 1 year before it will need to be forwarded to you at our normal prices or it will be destroyed.
Our fees
We charge a monthly fee for our virtual office address service of £4.99 a month, or £59.88 a year with the following additional costs as per below;
Mail forwarding
If you would like your mail forwarded on to you, we will charge:
Letters – 75p + postage
Parcels – £1.50 + postage
* Note, on months where post is forwarded, the total minimum charge is £3.
Scan to email
If you would like your mail scanned and emailed to you we will charge:
75p per scanned page.
* Scanned mail will only be stored for the period of 1 year before it will need to be forwarded to you at our normal prices or destroyed.
* We regret we cannot currently accept signed for items.
* We reserve the right to change our fees and charges at any time by updating their cost here on our website at https://www.stephenphillips.co.uk and in the terms, and by notifying our customers via email, in the event we do change our costs for our virtual office address customers then the new charges will take effect from the next billing cycle if paid month or yearly.
LIMITATION OF OUR LIABILITY
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use, our site; or
- use of or reliance on any content displayed on our site.
If you are a business user, please note that in particular, we will not be liable for:
- loss of profits, sales, business, or revenue;
- business interruption;
- loss of anticipated savings;
- loss of business opportunity, goodwill or reputation; or
- any indirect or consequential loss or damage.
INDEMNIFICATION
You agree to indemnify and hold Stephen Phillips from any third party claim, action, demand, loss or damages (including attorneys’ fees and costs) arising out of or relating to your violation of these Terms and Conditions, your use of the virtual office address service or your violation of any rights of a third party.
REMEDIES FOR VIOLATIONS
Stephen Phillips reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions.
APPLICABLE LAW
These terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
MISCELLANEOUS
If there is a determination that any provision of these Terms and Conditions is invalid or unenforceable, that determination will not affect the rest of these Terms and Conditions. Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our virtual office address service or under these Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.
